There is a vast body of both common law and equity that forms the foundation of the law of contract as we know it today. Common law is law made by the courts when they decide the cases that come before them. Equity is part of the common law, but it considers the fairness of the decision when deciding cases, rather than just basing decisions solely on prior case law.
