Bringing a claim at the Victorian Civil and Administrative Tribunal

The Fair Trading Act allows you to bring a wide range of matters to the Victorian Civil and Administrative Tribunal (VCAT). VCAT has a variety of orders it can make, including referring a dispute to a mediator, ordering money to be paid (including for damages), varying any term of a contract or declaring that a term of a contract is void (s. 108–9).

VCAT can, in determining a dispute, make any order it considers fair, and may consider issues such as the relative bargaining power of the parties, whether unfair pressure or unfair tactics were used and the intelligibility of the contract or term.
