If you have bought goods or services, or entered into a contract, in your home, at your workplace or at a sales seminar where you were reliant on the supplier for transport, you may have the right to cancel your agreement (s. 60). In general, you have a right to cancel within ten clear business days, or longer if the seller fails to provide the required cancellation notice (s. 61 and Part 1 of Schedule 2). For further information on what the notice should say contact Consumer Affairs Victoria or visit the CAV website - www.consumer.vic.gov.au.
In addition, unless the seller has your consent to do so, they cannot visit your home on a Sunday or a public holiday and only between 9am and 5pm on a Saturday and between 9am-8pm on a week day (s. 62A). A seller can only remain at your home for one hour unless you give your written consent to half hour extensions (s. 62B) or the seller is at your home for a party plan (s. 62B(3)). If you ask a seller to leave, they must do so immediately (s. 62C).
