Rural Law Online A guide to the law for Victorian Primary Producers

Planning permits for plantations

You will need a permit if you intend to clear native vegetation. Local councils are the bodies responsible for issuing permits. If a permit is issued, it will specify that you implement plans for a 'net gain' outcome, where overall gains are greater for native vegetation than overall losses and where individual losses are avoided where possible.

Regional Vegetation Plans (RVPs) provide guidelines for use in the assessment of applications to clear native vegetation. These RVPs are being produced by the Catchment Management Authorities in consultation with local communities in Victoria.

Plantation developers now work around native vegetation within a planting area. This has some economic cost but increases biodiversity and is in line with current community expectations.

If your plans do not involve the loss of native vegetation, you may not need a permit. But it is essential to check with the appropriate local council before commencing work. Where a permit isn't required you will need to lodge a Plantation Development Notice with the council for possible impacts on roads or other infrastructure.
