Legislation relating to motorists and stock on roads

The primary rule relating to road safety is that a 'road user must have regard to the rights of other road users and take reasonable care to avoid any conduct that may endanger the safety or conduct of other road users '. The Road Safety (Road Rules) Regulations 1999 (Vic) contains the details of responsibilities and duties of motorists and stock-owners when droving or grazing stock on roads in Victoria.

Persons moving 'animals under control ' are those moving stock in accordance with a council permit or doing so without the need for a permit (some councils do not require such permits). Such persons have the right to erect 'Give way to Stock ' signs and 'Stop ' signs at stock crossings.

The Australian Road Rules, which are Law in Victoria, require vehicles on bicycle paths and nature strips (other than riders of animals) to give way to animals on those paths. This rule (s.288 of the Road Rules) is complex.

It is an offence under The Road Rules for a vehicle to enter a level crossing if the crossing or the road beyond it is blocked by stock on the road.

Also under the Road Rules it is an offence for a person riding an animal to ride alongside more than one other rider unless overtaking the latter or droving stock

Other than these items the Road Rules do not deal with stock on roads
