Offences in an emergency

A police officer has the power under the Emergency Management Act 1986 (Vic) to use reasonable force to remove a person from (or prevent from entering) the emergency area, if they suspect a crime has been or will be committed.

You commit an offence under the Emergency Management Act 1986 if you:

  • obstruct, hinder or interfere with a person engaging in an emergency activity. Penalty: $1000.
  • fail to obey a prohibition, direction or official order without reasonable excuse. Penalty: $500.
  • enter or attempt to enter the emergency area having been ordered not to enter or having been prevented from entering. Penalty: $10 000.
